Late Thursday, hours before his own self-imposed deadline, Trump signed Executive Order 14326, setting final country-specific tariff rates from 10 to 41 percent for dozens of trading partners — effective not Friday, but one week later, August 7, the same one-week grace period he’d already given Japan.
Canada’s rate jumped to 35 percent, effective the very next morning. Mexico got a 90-day reprieve, announced hours before the deadline would have hit. Brazil stacked a new 40 percent “free speech” tariff, tied explicitly to the prosecution of former President Bolsonaro, on top of its existing 10 percent.
Three different countries got three different outcomes on the same afternoon — a delay, a spike, and a pause — decided not by a single formula but by whichever negotiation happened to be furthest along when the clock ran out. This wasn’t a tariff schedule. It was a triage list.
China wasn’t on the list at all. Its separate truce, negotiated in Geneva and refined in London, was still running on its own clock toward an August 12 expiration that nobody in Washington had addressed yet.
The deadline everyone was watching wasn’t the only one still ticking.
The Operation
The same Thursday Trump signed the new rates, eleven judges on the US Court of Appeals for the Federal Circuit sat en banc across town, hearing oral argument in the case that could determine whether he had the legal authority to impose any of them.
The lower court, the Court of International Trade, had already ruled the underlying legal theory — that a 1977 emergency-powers law covers ordinary trade deficits — exceeded presidential authority. That ruling was stayed months ago and never lifted, which is the only reason the tariffs Trump signed that afternoon were enforceable at all.
A president signed a tariff schedule while an eleven-judge panel spent the same afternoon debating whether he was allowed to. Both events were real. Only one of them could still be undone.
The order itself included a new weapon aimed at the gap between the two proceedings — a 40 percent penalty tariff on any goods customs determines were “transshipped” through a third country specifically to dodge the new rates, closing off the workaround before traders could fully exploit it.
Washington built the enforcement mechanism for a law it was still defending in court that same day.
Rules of Engagement
Every business that has spent 2025 rerouting supply chains around tariff letters now has a nominal deadline, August 7, that still sits underneath a live legal challenge that could unwind the entire rate schedule months from now — with no guarantee of a refund if it does.
Companies that already paid duties under the earlier rates are watching two clocks simultaneously: the compliance clock counting down to August 7, and the litigation clock that could eventually force the government to unwind and repay everything collected under a law the courts may yet rule never applied.
You are paying tariffs today under a legal theory a federal court has already called unlawful once — budget for the bill, because a refund, if it ever comes, will arrive on the court’s schedule, not yours.
